The Transport of Dangerous Goods (Safety Adviser) Regulations 1999 (S.I. 1999 No. 257 - ISBN 0-11-080434-1) came into force in the UK on 1 March 1999. The regulations impose very specific functions and duties on companies transporting dangerous goods by road, rail and inland waterways. These functions are the responsibility of the company's nominated Dangerous Goods Safety Adviser (DGSA). Companies covered by the regulations should have appointed their DGSA by 31 December 1999.

Functions of Safety Advisers

Monitoring compliance with the rules governing the transport of dangerous goods

Advising the employer on the transport of dangerous goods

Ensuring that an annual report to the employer is prepared on the dangerous goods activities of the employer

Monitoring the following practices and procedures relating to the transport of dangerous goods

bullet

the procedures for identification of dangerous goods

bullet

the practice in taking into account, when purchasing means of transport, any special requirements in connection with the dangerous goods to be transported

bullet

the procedures for checking the equipment used

bullet

proper training of the employer's employees and the maintenance of records

bullet

the implementation of proper emergency procedures

bullet

the investigation of and, where appropriate, preparation of reports on serious accidents, incidents or serious infringements

bullet

the implementation of appropriate measures to avoid the recurrence of accidents, incidents or serious infringements

bullet

the account taken of the legal prescriptions and special requirements in the choice and use of sub-contractors or third parties

bullet

verification that employees involved in the transport of dangerous goods have detailed operational procedures and instructions

bullet

the introduction of measures to increase awareness of the risks inherent in the transport of dangerous goods

bullet

the implementation of verification procedures to ensure the presence of the documents and safety equipment which must accompany transport and the compliance of such documents and equipment with health and safety regulations, and

bullet

the implementation of verification procedures to ensure compliance with legislation governing loading and unloading of dangerous goods.
